1.Prices quoted are per Square Meter or per Linear Meter as indicated.
2.Quantities quoted are the quantities of material required to cover the flooring area mentioned including wastage.
3.Should the final requested quantity vary substantially from the one quoted, then IDECO reserves the right to amend the prices accordingly.
4.Should the scope of the project change in terms of volume, width, design or complexity, a revised quotation will need to be provided.
5.While IDECO will try to deliver or despatch the goods by any date or within any period agree upon, such dates and periods are estimates only and IDECO will not be liable for any failure to deliver or despatch by such date or within such a period. Time for delivery shall not be the essence of the contract and will not establish any right to compensation for the buyer.
6. IDECO shall be entitled to delay delivery or, order to supplier, until any moneys due from the customer have been received.
7.If the customer requires delivery by express delivery, IDECO shall be entitled to add to the contract price, a reasonable charge for the express delivery.
8.Should IDECO be requested to, and agree to store any material, then IDECO shall be entitled to invoice the customer for the goods and shall, in addition, charge the customer storage costs. A separate order will be required for storage.
9. IDECO shall not be liable for any failure to perform its obligations caused by force majeure. Events of force majeure include, but are not limited to, the following: wars, civil unrest, fires, floods, delays in transit caused by port congestion, transport strikes, damage or loss sustained in transit, interruptions to energy or power supplies, break down of plant and machinery, strikes, lockouts and serious difficulties in obtaining supplies, including any delays by sub-contractors in the processing of the products.
10.The floor coverings must be installed on a floor that is flat*, hard, dry (with no rising bump), clean, smooth and dust free. (*) Flat floor = floor level must be maximum 5mm under the 2 meter rule. The floor must not have unevenness above 1mm every 20cm.
11.A minimum of three working days notice is required for planning or interventions on site. IDECO reserves the right to claim transport cost in the event that the site is not ready on the day of intervention.
12.Unless IDECO is provided with a closed and secured store, we will not be liable for any missing or damaged goods delivered on site and acknowledged by the client or his representative.
13. No complaints or claims would be accepted if the screed to covered does not meet IDECO’s minimum requirements as per clause 10 above.
14.Changes in order requirements already accepted by IDECO via a purchase order or signed quotation will be accepted in writing only (email/fax) at latest 24 hours after the order has been confirmed, and the production/cutting process has not started. In such cases, charges will apply with a minimum of MUR 500+vat. In the event that the production/cutting process has already begun, the customer will be charged the cost of the material made unusable for the processing of the modified order.
15. The customer should have their assets, business interruption and contractors all risks policies duly endorsed to waive the right of subrogation against IDECO Ltd and its insurers, arising out the execution of their contract and associated works. In case this is not done, we must be informed in writing in order for us to seek additional insurance coverage, the cost of which is not catered for in the price we have quoted for the present contract.
